OSHA Compliance and Safety Regulations.

Our client, Ally’s lotion manufacturing business (200 employees), thrives. The company earned 8 million dollars last year. However, in the last month, four workers at her manufacturing plant have been seriously injured while performing work duties. The injuries appear to be caused by ventilation issues, the use of hazardous materials (including acetylene and flammable liquids), and the lack of safety equipment.

Ally is concerned that the Department of Labor and the Occupational Safety and Health Administration (OSHA) are going to come after her and impose fines or shut down her business.

A law partner has asked that you research the following and prepare a letter to the client (see page 25 of our APUS Legal Studies Writing Guide) addressing the following:

  1. What exactly does OSHA do, and where does that agency fit within our three branches of government?
  2. What is the Occupational and Safety Health Act (provide the citation)?
  3. What are the regulations regarding workplace safety?
  4. What action can OSHA take against Ally’s company?
  5. What type of judge would hear Ally’s complaints about OSHA’s safety assessment and requirements of Ally’s company?
  6. How are OSHA rules created, and how does that compare to the legislative process?

  8. What action should she take? Can she terminate those workers?
