Laborers Local 773 is in the process of organizing a landscaping company of 30 workers. Over the past two months, the company owner has engaged in the following activities (some, but not all, of which are or could be illegal) during the campaign in the hopes of staying non-union:
- Included a fake paycheck stub (along with the real one) in all the workers pay envelopes showing what their workers take home pay would be after union dues are deducted
- Sent a supervisor to the parking lot where a union meeting is taking place to write down license plate numbers of attendees
- Had a foreman informally poll the workers to find out who is or isnt in favor of the union
- Spread the word that the company used to operate with a union in another part of the state. The company found it difficult to compete, so it shut down; 25 workers lost their jobs.
- Discharged the two most vocal union advocates on the job for poor job performance
- Notified workers through the foreman that management hears their concerns and if the union is voted out, everyone will get a $1 raise
- Had the foreman notify workers at each shift that unions are bad for business, and the company will probably shut down operations if they vote a union in
If you were the lead union organizer, based on the information provided, identify two (2) of these actions that you are confident are illegal on which you could file a ULP. Identify one (1) that is either legal or too iffy/weak to pursue a charge. Briefly explain your rationale for each, supported by lesson material.
