It is illegal for public sector unions to strike in 39 states and in those that allow striking, there are usually myriad hoops that must first be jumped through including mediation, arbitration and other dispute resolution measures. The basis for denying public sector unions the right to strike is obviously grounded in legitimate concern namely the stability and security of our countrys basic defense and infrastructure. However, on the other hand, denying the right to strike severely limits the ability of public workers to negotiate for better working conditions from a position of real power.
