Medco imported a shipment of surgical instruments used in hip replacements into the United States from China. The instruments contained a mark similar to one used by Medtronic for their surgical instruments. Medtronic has a registered trademark and patent for their devices and filed it with U.S. U.S. Customs and Border Protection (CBP) seized the instruments pursuant to the Tariff Act, which authorizes seizure of any merchandise bearing a counterfeit mark. Medco argued that the mark was not similar and their seller in China had a patent in China. However, the Chinese patent was not registered in the United States.
